Lawful Communication Methods Debt Collectors May Use
What are acceptable methods collectors can use to contact you?
What a debt collector can do: A debt collector may communicate with you by mail, in person, by telephone or telegram. A debt collector cannot contact you before 8 a.m. or after 9 p.m. A debt collector cannot contact you at times or in places that they know are inconvenient to you, such as at work if your employer does not permit it or during daytime sleep hours if you work 2nd or 3rd shift.
How you stop communications with a debt collector: Send a written request to a debt collector demanding that they stop contacting you, the debt collector must stop contact immediately, but they may send one last communication to you advising you that they intend to take a specific action against you including filing a lawsuit.
How an attorney help you: If you hire an attorney to represent you for a consumer debt, a debt collector CAN NOT communicate directly with you and must communicate through your lawyer.
What a debt collector can not do: A debt collector CAN NOT contact ANY third party about your debt. The debt collector can not call your neighbor, your siblings, or your employer. Debt collectors are not allowed to tell anyone but you and your attorney that you owe money to someone else. However, a debt collector may contact other people once, and only once, in an effort to locate you. A debt collector can not ask your neighbor to give you a message or return a call.
