Bankruptcy won’t fix all your debt problems in Southeastern Wisconsin.
A bankruptcy won’t get rid of:
- Taxes:
- Income taxes less than three years old
- Income taxes over three years old from a tax return not filed more than two years ago
- Income taxes not assessed at least 240 days ago.
- Payroll, sales or property taxes
- Certain federal taxes that are defined as non-dischargeable
- Willful evasion of tax or fraudulent tax return
- Criminal fines or restitution or drunken driving injury claims
- Guaranteed Educational Loans
- Fines or penalties owed to governmental unit
- Damages arising from willful injury to person or property
- Spousal or child support, or ex-spouses attorney fees for obtaining support
- Professional Malpractice under extreme circumstances
- Debts incurred by fraud or lying with the intent to deceive
- Secured Debts where you want to retain your collateral, such as vehicles, home, etc. (Your personal liability for it can be discharged, but payment must be made to retain the property)
- Tax or judgment claims secured by lien on property owned by debtor
- Co-signed debts where debtor does not want creditor to go after the co-signor.
